Welcome to the use of Tarsier camera products and services provided by Visinse Technology Co., Ltd. (hereinafter referred to as "Visinse") and Chengdu CALF Technology Co., Ltd. (hereinafter referred to as "CALF"). Tarsier is a portable camera with photo-taking, video recording, and live streaming functions.
In order to protect your rights and interests, pleaseIn order to protect your rights and interests, please this agreement carefully before using the it means that you have reached an agreement with Visinse and CALF, and voluntarily accept all the contents of this agreement.
This agreement is between you and Visinse/CALF regarding your use of Tarsier, including the main body of the agreement, other agreements explicitly referred to in this agreement, and various rules that may be released in the future. All rules are an inseparable part of this agreement, having the same legal effect as the main body of the agreement. Unless otherwise expressly stated, your use of services provided by Tarsier is subject to this agreement.
1、During the use of Tarsier, you shall not use Tarsier to create, upload, copy, transmit, disseminate, or reproduce the following content:
(1) Opposing the basic principles established by the Constitution of the People's Republic of China;
(2) endanger national security, divulge state secrets, subvert the state power, or undermine national unity;
(3) Damage national honor and interests;
(4) Instigate ethnic hatred, ethnic discrimination, and undermine ethnic unity;
(5) Undermine the national religious policy, promote cults and feudal superstitions;
(6) Spreading rumors, disrupting social order, and undermining social stability;
(7) Spreading obscenity, pornography, gambling, violence, murder, terrorism, or instigating crime;
(8) Insulting or defaming others, infringing on the legitimate rights and interests of others;
(9) Promoting terrorism, extremism, or instigating the implementation of terrorist activities or extremist activities;
(10) Abusing the image of heroes and martyrs, denying or distorting their deeds, beautifying or whitewashing invaders and acts of war;
(11) Attacking or defaming the leaders of the Party and the country, fabricating negative information about the leaders, and misusing the leaders' image;
(12) Content that violates public order and good customs, such as vulgar wedding celebrations;
(13) Containing other content prohibited by the laws and administrative regulations of the People's Republic of China;
(14) Content describing sexual behavior, sexual processes, or sexual methods using sexually suggestive or provocative language;
(15) Publishing other content that does not conform to the public's aesthetic.
2、You shall not use the Tarsier platform or services to perform acts including but not limited to the following:
(1) Creating, copying, publishing, or disseminating information and works that are prohibited by laws and regulations, or infringe upon the intellectual property rights or other legitimate rights and interests of other users or third parties;
(2) Logging into or using the Tarsier platform or services through third-party compatible software or systems that are not developed, authorized, or recognized by Tarsier, or using plugins that are not developed, authorized, or certified by Weixi or Kaifei companies for the Tarsier platform and related services;
(3) Performing reverse engineering, reverse assembly, reverse compilation, or other illegal methods to obtain source code of the Tarsier system or upper-level applications without the consent of Visinse and CALF companies;
(4) Other acts that violate laws and regulations, policies, public order and good customs, social ethics, or interfere with the normal operation of Visinse and CALF companies and infringe upon the legitimate rights and interests of other users or third-party cooperation platforms.
3、Under any circumstances, Visinse and CALF companies reserve the right to refrain from publishing or providing your captured and uploaded works to users based on relevant laws, regulations, and policy considerations related to the works.
1、The information you provide when registering for a Tarsier service account should be your genuine personal identity information. You should ensure that the personal information you provide during registration (including identity information, contact details, residential address, etc.) is true, complete, and valid, and you should bear corresponding legal responsibility for the information provided in accordance with legal provisions and the terms of this agreement.
2、Visinse and CALF companies have the right to review whether the information you provide during registration is true and valid. If the account registration information you provide to Visinse and CALF is inaccurate, untrue, or contains illegal or inappropriate information, Visinse and CALF companies have the right to refuse registration. For accounts that falsely register using the names of affiliated organizations or public figures, Visinse and CALF reserve the right to terminate the account and report to the government authorities.
3、You should properly safeguard your account and password and use your account and password correctly and securely. You are not allowed to gift, lend, rent, transfer, or sell your account. If you fail to properly safeguard your account and password, causing harm to the civil rights of Visinse and CALF companies, and others, you shall bear all responsibilities.
4、When registering and using a Tarsier account, you should abide by the seven principles of laws and regulations, socialist system, national interests, legitimate rights and interests of citizens, public order, social ethics, and authenticity of information. No illegal or infringing information should appear in your registration information. If your account has the aforementioned issues, Visinse and CALF companies have the right to take measures such as notifying you to make corrections within a specified period or suspending use.
If you discover that your account or password is being used illegally by others or there are abnormal usage patterns, you should promptly notify Visinse and CALF companies in accordance with the handling methods published by them. Since Visinse and CALF companies cannot distinguish between illegal use of your account and legitimate use, they have reason to believe that the actions taken under your account are your own actions until you file a complaint or submit an account appeal to explicitly inform Tarsier that your account has been used by others or that information has been leaked, and provide relevant evidence.
Tarsier may provide access to or links to third-party websites or services, which are operated by the respective third parties and are not under the control of Tarsier. Your use of such third-party websites or services (including any information you provide to such third parties) is subject to the third party's own terms of service and information protection policies (not this policy), and you should carefully read their terms. If you find that these third-party websites or services pose risks, we recommend that you terminate the relevant operations to protect your legitimate rights and interests. Visinse and CALF companies will not be responsible for any losses or damages caused by your use or reliance on the aforementioned third-party websites or services.
1、Visinse and CALF companies encourage and support creativity, sharing of works, and mutual learning. To avoid disputes, the term "works" referred to in this agreement includes works in any form (such as images, videos, live broadcasts, etc.), audio and video recordings, code, comments, posts, or other content published by users on the Visinse and CALF platforms.
2、Visinse and CALF companies respect intellectual property rights and emphasize protecting the rights enjoyed by users. All original works you publish on the Visinse and CALF platforms are copyrighted by you, and you may authorize third parties to use them in any way without obtaining the consent of Visinse and CALF companies. By publishing your works, you agree to grant Visinse and CALF companies a free license to publicly disseminate, promote, and use your works.
3、Except for the works you create and publish yourself, all other content on the Visinse and CALF platforms, including but not limited to products, software, audio and video materials, graphic and textual information, interface design, layout frameworks, icons, data, etc., are owned and copyrighted by Visinse and CALF companies. Therefore, you can only use this content under the authorization of Weixi and Kaifei companies. Without the written consent of Visinse and CALF companies, you are not allowed to copy, publish, use, rewrite, or authorize third parties to use or exploit this content for any profit-making or non-profit-making purposes.
1、You may not be able to use certain functions of the Tarsier camera in non-login mode, and once you exit or change devices, any relevant data in non-login mode may be cleared and cannot be retrieved or restored. Visinse and CALF companies will not be responsible for any losses caused by this.
2、Any content, information, or other materials posted by users on the Visinse and CALF platforms do not reflect or represent the views, positions, or policies of Visinse and CALF companies. Visinse and CALF companies will not be responsible for any errors, omissions, or any losses or damages resulting from such content. Visinse and CALF companies have the right (but not the obligation) to refuse or delete any content on the Visinse and CALF platforms at their discretion. If you use such content, you do so at your own risk.
3、If Visinse and CALF companies take measures to suspend or terminate your registered account due to your own reasons (including but not limited to violations of laws, regulations, or the terms of this agreement), you will not be able to continue using the registered account, and Visinse and CALF companies will not be required to compensate or indemnify you in any form.
4、In any of the following circumstances, Visinse and CALF companies may need to change, interrupt, or terminate all or part of the services provided by the server. Visinse and CALF companies will not be responsible to you or any third party for any inconvenience or damage caused by this:
(1) Regular inspections, maintenance, or updates of the website and server to provide you with more professional and convenient services, including hardware and software updates.
(2) Network provider line or other failures.
(3) In emergency situations, in accordance with legal provisions or for the personal safety of you and third parties.
(4) Execution of administrative/judicial orders.
(5) Third-party causes or other force majeure situations.
5、During the provision of services, Tarsier may deliver commercial advertisements and other commercial information in various ways. You agree that Visinse and CALF companies have the right to send you such information via email to your registered email address, private messages to your account, or through other means.
Respecting user privacy is a fundamental policy of Visinse and CALF companies. Visinse and CALF companies will collect, store, use, disclose, and protect users' personal information in accordance with the "Tarsier Privacy Policy" published on the Tarsier camera application. Please read the privacy policy thoroughly to help you better protect your personal information.
1、In any of the following situations:
(1) Violation of any rule stipulated in this agreement;
(2) Violation of the platform rules issued and updated periodically by Visinse and CALF companies;
(3) Provision of false personal information or the existence of illegal or inappropriate content;
(4) Other acts that "harm the interests of Visinse and CALF" including but not limited to the aforementioned.
Visinse and CALF companies have the right, depending on the severity of the situation, to take one or more of the following measures against the user:
(1) Suspend/terminate the provision of all or part of the services;
(2) Delete the illegal content;
(3) Temporarily/permanently ban the account;
(4) Deduct, clear, or confiscate part or all of the virtual assets.
Due to the possibility of the above-mentioned situations, Visinse and CALF companies have the right to delete your personal information or anonymize it in accordance with the requirements of relevant laws and regulations. It is recommended that you regularly back up your published works.
2、If you violate the provisions of this agreement, relevant service terms, or platform rules, resulting in third parties making claims against Visinse and CALF companies, and their affiliated companies or partner companies, you agree to bear all legal responsibilities, including but not limited to compensation, fines, settlement fees, litigation and arbitration fees, reasonable legal fees, etc., and agree to compensate for any damage caused to Visinse and CALF companies. The specific ways to assume compensation responsibilities include but are not limited to paying funds equivalent to the losses to Visinse and CALF companies according to their written notice, using accumulated virtual assets to compensate for related losses, etc.
3、Visinse and CALF companies fulfill reasonable and prudent obligations with respect to intellectual property rights. When a third party believes that your work uploaded or published on the Visinse and CALF companies platform infringes on their rights and sends a notice of rights to Visinse and CALF companies in accordance with the "Regulations on the Protection of the Right to Network Dissemination of Information" or relevant laws and regulations, you agree that Visinse and CALF companies have the right to delete the suspected infringing work without prior notice to you.
1、If you are under 18 years old, you should access and/or use the hardware and network services of Visinse and CALF companies with the consent and guidance of your guardian, and your guardian should allow you to use the hardware and network services of Visinse and CALF companies and agree to the terms of this agreement. If you are the guardian of a minor, it means that you agree to bind the minor to comply with these terms and use the hardware and network services of Visinse and CALF companies.
2、Minors should reasonably arrange their time to use the hardware and network services of Visinse and CALF companies under the guidance of their guardians, paying attention to avoiding addiction and affecting normal study and life.
1、You understand and agree that Visinse and CALF companies are constantly changing and improving services for the overall operation of the platform. The Tarsier camera may add or delete some services, or suspend or completely stop this service. You agree that Visinse and CALF companies have the right to exercise the above rights without any responsibility to you or third parties.
2、If Visinse and CALF companies decide, based on their own business decisions or judgment, that your behavior is suspected of violating the content of this agreement, corresponding usage rules, or laws and regulations, Visinse and CALF companies have the right to suspend, interrupt, or terminate the provision of services to you. In such cases, Visinse and CALF companies have the right to delete your personal information or anonymize it in accordance with the requirements of relevant laws and regulations.
3、If Visinse and CALF companies decide to terminate the operation of the service due to their own reasons, you should take corresponding measures to handle your account independently, including but not limited to canceling or stopping the use of the account and other related matters.
Visinse and CALF companies are not responsible for losses caused by force majeure. Force majeure includes: natural disasters, changes in laws, regulations, or government directives; unique reasons due to the characteristics of network services, such as failures of domestic and international basic telecommunications operators, computer or internet-related technical defects, sudden failures of hardware, software, and electronic communication equipment, limitations on internet coverage, computer viruses, hacker attacks, and other unforeseeable, unavoidable, and uncontrollable objective conditions within the scope of legality.
1、Notifications: All notifications sent to you may be transmitted via email, regular mail, or announcements in prominent positions on the website/client.
2、This agreement is governed by the laws of the People's Republic of China (excluding conflict of laws). If any content of this agreement conflicts with the laws of the People's Republic of China, the legal provisions shall prevail, and the relevant content will be modified or reinterpreted in accordance with the legal provisions, without affecting the legal effect of other parts of this agreement.
3、Any disputes arising from the content or execution of this agreement shall be resolved through friendly consultation as far as possible. If the negotiation fails, all parties to the dispute agree to submit the dispute to the China International Economic and Trade Arbitration Commission for arbitration in accordance with the effective arbitration rules of the commission at the time of application, and the arbitration shall be heard by three arbitrators. The arbitration award is final and binding on both parties.
4、This agreement shall be implemented from the date of issuance and constitute a consensus between you and Visinse and CALF companies.
5、The failure of Visinse and CALF companies to exercise, fail to exercise in time, or fail to fully exercise the rights granted under this agreement or by law shall not be deemed as a waiver of such rights, nor shall it affect Visinse and CALF companies's exercise of such rights in the future.
